ViralNow Terms Of Service

Terms of Service

1. Acceptance of Terms By using ViralNow, you agree to these Terms of Service. If you do not agree, do not use our platform.

2. User Accounts

  • Accounts are strictly personal (one per person).
  • We may ban accounts for violations of these terms.

3. Payments and Refunds

  • All payments are final, and we do not offer refunds. Any refund requests must be handled directly through the App Store or Google Play, subject to their respective policies.

4. User Content

  • Users own 100% of their content.
  • Every user is fully responsible for their content on ViralNow.
  • We do not claim any rights over your data.
  • Users are not allowed to upload any images or content that are sexually suggestive in any forms. We have strict security measures to prevent that from happening.
  • The user represents and warrants that they have all necessary rights to the content they submit, and that such content does not infringe the intellectual property rights, including copyright, of any third party. The user agrees not to upload content that they do not own or do not have permission to use, including but not limited to videos containing copyrighted audio or video materials.
  • By submitting content, the user grants ViralNow a limited, non-exclusive, worldwide, royalty-free license to process, analyze, and temporarily store the content solely for the purpose of providing and improving the service. This license automatically terminates when the content is deleted.

5. AI-Generated Content

  • Copyright Status: The copyright status of AI-generated content may vary by jurisdiction. While we provide the tools for creation, users are responsible for understanding the copyright implications in their jurisdiction.
  • Content Responsibility: Users are solely responsible for the content they generate using our AI tools.
  • No Legal Advice: We do not provide legal advice regarding the use or copyright status of AI-generated content. Consult a legal professional for guidance specific to your situation.

6. Prohibited Activities

Users must not:

  • Spam, launch DDoS/DoS attacks, or engage in malicious activity.
  • Use the platform for illegal purposes.
  • Attempt to exploit vulnerabilities.
  • Generate content that is defamatory, violates intellectual property rights, or is otherwise illegal.
  • Use the platform for any other purpose that is not permitted by these terms.

7. Account Termination

We reserve the right to terminate accounts without refund and any prior notice if users violate these terms. When such an event occurs, no refunds are guaranteed.

Upon termination, Your right to use the Service will cease immediately.

8. “AS IS” and “AS AVAILABLE” Disclaimer

ViralNow is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. To the fullest extent allowed by law, ViralNow and its affiliates disclaim all warranties, express or implied, including merchantability, non-infringement, and fitness for a particular purpose. We do not guarantee that the service will be error-free, uninterrupted, or meet your expectations.

AI-generated results may be inaccurate or unsuitable for specific purposes. We are not responsible for third-party services, integrations, or content. Use ViralNow at your own risk.

ViralNow cannot guarantee your content’s performance or success. The product, your content, is a prediction based on historical data. Past performance is not indicative of future results.

9. Limitation of Liability

To the maximum extent permitted by law, ViralNow’s total liability for any claim arising out of or relating to the service shall not exceed the amount the user paid for the service in the past 12 months.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law principles. The user’s use of the Service may also be subject to other local, state, national, or international laws depending on their jurisdiction.

11. Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting ViralNow at [email protected].

12. Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

13. Changes to Terms We may update these terms periodically. Continued use of the service after updates means you accept the new terms.

14. Compliance with Sanctions and Export Laws

You may not use or access ViralNow if you are located in a country or region subject to U.S. or other applicable government sanctions, or if you are listed on any government list of restricted parties. By using ViralNow, you confirm that you are not subject to such restrictions.

You may not use or access ViralNow if you are located in Europe. Any attempts to do so will be met with immediate termination of your account.
